The IT & Web Design policy explained...
What's special about this policy?
Most Professional Indemnity policies only cover IT professionals for the services they provide. However, we recognise that many IT professionals need better protection and so our policy gives you much wider scope providing cover for designing, producing or supplying items such as software, hardware, firmware, cabling and electronic equipment.
Our policy works for you in four ways:
- You are covered for claims made against you in the course of your work for clients.
- Your defence costs, your liability to third parties and claimants’ costs will be covered.
- You are protected from the costs of putting a mistake right if this will avoid a claim being made against you.
- In certain circumstances your fees will be covered if a client refuses to pay because of your negligent act and threatens to counter-claim if you pursue what's owed to you.
Your business is protected:
- against claims from negligence and breach of duty or care
- from negligent misstatement or negligent misrepresentation
- against claims for defamation
- if you inadvertently infringe someone else’s copyright
- against dishonesty of partners, directors, employees or self-employed freelancers
This policy from Blyth Valley means that you're playing on a level playing field with clients larger than yourself. It covers you for claims made against you and helps you avoid costly legal disputes. The policy even provides cover if your client simply refuses to pay, but threatens to counter-claim if you pursue what's owed to you.

Why do you need Professional Indemnity Insurance?
It's business: mistakes happen no matter how careful you are. And in the digital world, disagreements frequently arise when clients expect something you never promised to deliver.
You'll be able to settle most disputes amicably by referring back to the contract you and your client signed at the start of the project. When this isn't the case, you'll be thankful that you had professional indemnity insurance to protect you.
Without PI, you could find yourself having to pay damages far in excess of the contract value, at the mercy of a client who can afford astronomic legal costs.
At Blyth Valley, our specialist PI policies are sourced from insurers with a sound knowledge of technology risks. Many standard PI policies will exclude the manufacture of hardware or software: prime sources of revenue for many IT businesses. Not ours. It's written specifically for contractors and independent businesses in the IT sector.
Claims example
In the course of making back-ups of a client’s hard disks, a self-employed IT technician accidentally overwrote all the data on the hard drives belonging to his client. He immediately employed a specialist to retrieve the data, but unfortunately they could only confirm that the data was irretrievably lost. The insurers assessed the claim in the light of speculative losses and a settlement was agreed at a quarter of the amount claimed by the client without any need for expensive litigation.
